NC Local and State Agency Purchase of Computer Equipment and TelevisionsNC General Statute 130A Article 9 Part 2H, passed in the 2010 General Assembly Session, establishes a number of requirements on vendors of computer equipment and televisions with the general goal of fostering a statewide recycling infrastructure for these materials. The requirements include annual registration with the state, payment of annual registration fees, labeling provisions, submittal of recycling plans (for computer manufacturers only) and annual reporting. NC General Statute 147-33.104A stipulates that no State agency, political subdivision of the State, or other public body purchase computer equipment or televisions or enter into a contract with any manufacturer that is not in compliance with the requirements of the legislation. NC DENR is required to provide information to the state Office of Information Technology Services (OITS), which shall in turn make the list available to political subdivisions of the State and other public bodies. A manufacturer not in compliance with its requirements is also responsible in its own right for not selling or offering for sale computer equipment or televisions to the State, a political subdivision of the State, or other public body.
